MTN Ghana to challenge SMP decision

MTN Ghana has announced it will seek judicial review of the National Communication Authority’s (NCA’s) decision earlier this month to designate the operator as having Significant Market Power (SMP) and impose special regulatory restriction on the company. In a statement issued on 26 June, MTN Ghana noted that although it acknowledges the regulator’s duty and powers to promote fair competition in the telecoms sector, ‘the manner of the recent declaration of MTN as a Dominant/SMP player raises concerns about clear procedural breaches and substantive issues’. The company maintains that ‘as a responsible and ethical leader, MTN is neither aware of any industry economics/market study to establish market failure nor has MTN taken any steps or engaged in an anti-competitive behaviour’.
