Apex court agrees to partial refund for Vodafone Idea

India’s Supreme Court has ordered the tax department to issue a refund of INR7.33 billion (USD98 million) to mobile provider Vodafone Idea within four weeks, the Economic Times reports. The cellco had sought a total refund of INR47.59 billion in relation to assessments for the years from 2014/15 to 2017/18, but the apex court approved only the refund for the 2014/15 year. In its ruling, the apex court said that, with the exception of the INR7.33 billion refund, it ‘saw no merit’ in Vodafone Idea’s case and dismissed the appeal. The paper quotes a local legal expert as saying that the Supreme Court had in effect ‘dismissed Vodafone’s appeal and upheld [the] tax department’s action of withholding approximately INR40 billion in refund, due to pendency of tax proceedings for various years’.
