Watchdog looks into UPC takeover

Switzerland’s Competition Commission (Wettbewerbskommission, COMCO/WEKO) has announced that it will conduct an in-depth review of the planned takeover of cableco UPC Switzerland by full-service provider Sunrise. In a statement from the watchdog, COMCO noted that its initial study found that there were indications of single market dominance for the provision of sports rights on pay-TV as well as in the markets for IP interconnection access to the end users of Sunrise and UPC. The regulator also warned that there were indications of the creation or strengthening of collective dominance with Swisscom in the retail broadband and fixed line telephony markets as well as the ‘platform market’ for transmission of linear digital TV and the ‘regional platform market’ for VoD. COMCO’s secondary study will take no more than four months.

Responding to the development, a press release from Sunrise stated that the telco had expected the regulator to conduct a more detailed study. The operator added that it still expects the transaction to be approved by the antitrust authority, with a decision anticipated by the beginning of October 2019. As such, Sunrise expects to complete the transaction by Q4 2019.
