CNMC rejects calls to suspend network sharing agreement

The Comision Nacional de los Mercados y la Competencia (CNMC), Spain’s newly enlarged competition watchdog, has announced that the network sharing agreement between Telefonica Espana (Movistar) and Xfera Moviles (Yoigo), will not be suspended despite an ongoing investigation into the deal. Rival cellcos Vodafone and Orange had sought for a provisional suspension to be imposed until the investigation was concluded. However, Jose Maria Marin Quemada, the president of CNMC, said that levying a suspension at this juncture would not ‘improve or accelerate the investigation’. The CNMC has previously indicated that the investigation into the agreement may last up to 18 months.
