ACCC launches discussion on creation of Independent Telecommunications Adjudicator

30 Mar 2012

The Australian Competition and Consumer Commission (ACCC) has announced the release of a discussion paper in which it invites comments and submissions on the draft documents relating to the proposed establishment of an Independent Telecommunications Adjudicator (ITA). The development comes on the back of the recent approval of fixed line incumbent Telstra’s Structural Separation Undertaking (SSU); that undertaking requires Telstra to implement a number of dispute resolution processes, including an ITA scheme. In its discussion paper the ACCC is seeking feedback on the draft versions of an ITA constitution, as well as a charter of independence, and interested parties have until 20 April 2012 to make their submissions. Commenting on the proposals, ACCC chairman Rod Sims noted: ‘The confidence of Telstra’s wholesale customers in the ITA will be important to ensure the success of Telstra’s interim equivalence and transparency commitments and its obligations under the migration plan.’
