TDSAT tells DoT to reconsider fines against Idea Cellular

India’s Telecom Disputes Settlement and Appellate Tribunal (TDSAT) has reportedly set aside a previous decision by the Department of Telecommunications (DoT) which imposed liquidated damages on mobile network operator Idea Cellular for failing to achieve rollout obligations. According to India’s Economic Times, the TDSAT has claimed that Idea was denied an opportunity to present its case, while also alleging that the DoT ignored established procedures in reaching its original verdict. As a result, the tribunal has called on the regulator to restart the process for examining the matter. The development comes after Idea filed a number of petitions challenging the INR276 million (USD5.38 million) fine that had been levied against it for allegedly delaying rollouts in five circles: Karnataka, Punjab, Haryana, Andhra Pradesh and Maharashtra.
