Court dismisses Iliad’s call to halt 4G mobile licence auction

France’s supreme administrative court, Conseil d’Etat, has dismissed a call by alternative operator Iliad (Free) to stop the forthcoming auction of licences for 4G mobile services. The altnet had submitted a petition for an emergency injunction to halt the auction – slated to kick off on 15 September – arguing the terms and conditions were unfair. Iliad claimed the stipulation that all operators pay upfront for the licences on offer prejudiced smaller companies with less financial muscle than larger players such as France Telecom and Vivendi. It had called for a change in the bidding rules to allow for payment of the licence in instalments However, the Conseil d’Etat dismissed the bid, but said it will deliver a ruling on the matter in the coming months, which may yet halt or amend the auction process.
