A Provincial Administrative Court in Poland has supported the Office of Electronic Communications (UKE) in its decision to dismiss a joint complaint brought by Orange Poland, T-Mobile Poland and Plus. The three cellcos sought to overrule the allocation of two 15-year, general exclusive frequency licences in the bands 1710MHz-1730MHz and 1805MHz-1825MHz to P4 and Aero2. The three immediately challenged the concessions awarded to P4 and Aero2 in 2007, but the UKE’s president ruled against them in December 2008. This final decision was the result of their continued legal action.
According to TeleGeography’s GlobalComms Database, at the end of March 2011 Orange Poland, Plus and T-Mobile Poland had market shares of 30.4%, 28.9% and 27.8% respectively, compared to P4’s 11.6% and Aero2’s 0.5%.
