Court of Appeals upholds NTC’s 3G licence awards

The Court of Appeals of the Philippines has ruled that the National Telecommunications Commission (NTC’s) award of 3G mobile frequencies in 2005 was legal and rightfully belongs to the nation’s largest telcos. At the time the regulator issued the licences to PLDT’s mobile arm Smart Communications, Globe Telecom, Digitel (Sun Cellular) and Connectivity Unlimited Resource Enterprise (CURE), which was later acquired by Smart. In its 23-page ruling the appellate court threw out an appeal by another Filipino operator Multimedia Telephony Inc. (MTI), saying that enough evidence exists to support the watchdog’s decision and as such, ‘seals the ruling with finality’. Local press reports also note that this the second Court of Appeals ruling in the last 30 days that has upheld the NTC’s 3G licence awarding process and evaluation.
