OTE local loop fines upheld but reduced to EUR5.7m

The Administrative Court of Appeals of Athens has upheld a National Telecommunications and Post Commission (EETT) decision fining OTE for infringement of Greece’s electronic communications legislation and for abuse of its dominant position, according to the International Law Office. The EETT based its decision on ‘unjustified delays’ in OTE’s provision of local loop copper pairs to rivals. However, the appeal court reduced the fine amount, to a total of EUR5.7 million (USD7.4 million) from the previous EUR9 million, whilst the report noted that OTE is expected to bring a further action for annulment of the decision before the Council of State.
