Cologne court orders recalculation of LLU fees

German federation for alternative operators VATM has welcomed a ruling by the Administrative Court in Cologne against the Federal Network Agency’s (FNA’s) 2001 decision regarding fees charged for local loop unbundling (LLU). The court has ordered a new LLU fee calculation method based on historic actual costs made by incumbent telco Deutsche Telekom (DT) for the expansion and upgrade of its DSL network. The court’s verdict rules that the FNA must recalculate the monthly LLU fees for the years 1999-2001 and 2001-2003, although both DT and the regulator are allowed to appeal the decision. According to TeleGeography’s GlobalComms database, the FNA cut the last mile fee by 2.9% on 1 April 2009 to EUR10.20 (USD14.59) using the old calculation model, a move criticised by the VATM.
