Telekom Austria fined EUR1.5 million

Austria’s incumbent fixed line operator, Telekom Austria, has been fined EUR1.5 million (USD2 million) for abuse of its dominant market position. The Federal Competition Authority (Bundeswettbewerbsbehoerde – BWB) took the telco to Austria’s cartel court over its local loop unbundling (LLU) policy which was deemed unfair to competitors. Rival wireline operator UPC Austria welcomed the fine, saying, ‘We believe an important step has been taken to ensure fair competition in the Austrian telecommunications market.’ Telekom had 1.95 million fixed lines in service at the end of 2008 and is obliged under the Telecommunications Act 2003 to grant competitors non-discriminatory access to parts of its network
