Court agrees Swisscom must offer bitstream access at regulated prices

On 19 February Swisscom announced that the Federal Administrative Court had confirmed a Communications Commission (ComCom) decision of 21 November 2007 which ordered Swisscom to offer bitstream access at regulated prices. The proceeding against Swisscom was initiated by TDC Switzerland, which operates in the country under the brand name Sunrise. In its press release Swisscom stated that it has accepted the judgment and will allow bitstream access at regulated prices. With a view to the proceeding pending against Swisscom before the Competition Commission for abusive pricing of the asymmetric digital subscriber line (ADSL) market, Swisscom continues to maintain that it has not misused its market dominance.

Following an investigation, the Competition Commission Secretariat has petitioned ComCom to issue a fine against Swisscom in the amount of CHF237 million (USD201 million) for price/margin squeezing in the ADSL market. The commission has not yet issued its decision.
