iPCS drops Sprint injunction

The Sprint Nextel affiliate wireless operator iPCS has withdrawn its request for an injunction which would have blocked Sprint’s proposed WiMAX tie-up with Clearwire. iPCS had sought a temporary restraining order to stop the merger, though it has now agreed to drop the request for an injunction if Sprint/Clearwire agrees to give it at least two months notice of any launches in iPCS service areas. While this clears the way for the merger to go ahead, iPCS is continuing with its legal fight to stop the WiMAX venture operating in its own territories, arguing that it has signed an exclusivity agreement with Sprint which allows iPCS to operate in certain regions with no competition from its larger partner.
