Sprint must wait until December for iPCS decision

A court in Delaware has ordered a stay in a lawsuit between cellular operator Sprint Nextel and its affiliate operator iPCS pending the outcome of a similar case in Illinois. iPCS is attempting to block Sprint from offering WiMAX wireless broadband services in regions where it operates, as these services would contravene an exclusivity agreement which states that Sprint cannot compete directly against its affiliate. The case is due to be heard in Illinois in December. Sprint argues that its WiMAX offering will not contravene the exclusivity agreement as it is proposing to spin off its WiMAX business and operate under a joint venture with wireless ISP Clearwire.
