Telefonica may still have to provide wholesale access to fibre network

Spanish news source Cinco Dias is reporting that the Audiencia Nacional de Espana, Spain’s high court, has temporarily overturned the ruling by the Telecommunications Market Commission (CMT) that Telefonica will not have to offer wholesale services on its new fibre network; the move comes following a submission by Orange Espana to the high court contesting the Spanish regulator’s July 2008 decision that ruled Telefonica would only be obliged to allow access to its cable ducts. The court has asked all parties involved to submit their positions for consideration by 22 September, when it is expected that a final ruling will be made. Telefonica recently announced that it was to launch commercial FTTH services at the end of October 2008; it is unclear whether the recent development will affect the launch window.
