Appeals court upholds EUR80 million fine for FT

A French appeals court has upheld a EUR80 million fine previously imposed on France Télécom for blocking rivals’ access to the high speed internet access market prior to October 2002. French competition regulators issued the fine on 7 November 2005 saying the incumbent had ‘abused its dominant position on the local loop and its extension to the broadband access server…which had the effect of artificially maintaining its quasi-monopoly on the market for high-speed internet by ADSL’. The appeals court upheld the decision and ruled that the actual amount of the fine was justified given ‘the seriousness of the acts’.
