Smart granted interim injunction against ComReg

15 Feb 2006

Smart Telecom has been granted a temporary injunction against the national telecoms regulator ComReg, barring it from awarding the country’s fourth 3G licence to another operator. In a press statement delivered last night, Smart Telecom said it had been granted an interim injunction, ex parte, restraining ComReg from reallocating the concession until ordered to do so by the High Court.

Yesterday, ComReg withdrew Smart Telecom’s licence to provide high speed 3G mobile services on the grounds that it believed the company had failed to meet certain conditions of its original offer. Smart strong refutes ComReg’s accusation and action and has initiated the legal proceedings to enforce the award of the licence. A further hearing of the injunction has been scheduled for Thursday 16 February.
