Telekom will continue tax fight

Telekom Austria has said it will continue legal action to try to halt the taxation of cellular mast sites, despite a ruling by Europe’s highest court which says such taxes are legal. The European Court of Justice ruled yesterday in a case involving Belgian mobile operators Belgacom and Mobistar and the municipal councils of Fleron and Schaerbeek, deciding that the taxation of wireless masts complies with a 1997 telecoms directive. Telekom Austria, whose mobilkom unit is Austria’s largest cellular operator, is fighting to stop the proposed taxation of its masts in the region of Lower Austria. The local government there intends to begin levying the tax from 1 January 2006.
